Sounds like we're going to be getting good news in the Supreme Court Grokster case. I've heard Scalia almost always walks in with his mind decided and leads with questions toward his side (from a New Yorker article last week). Judging by his questions it seems like he's drifting towards Grokster. And the liberal judges will certainly side toward Grokster, and Thomas follows Scalia like a little bitch so... This could be near unanimous!

Let's everyone keep our p2p fingers crossed, eh?

It's the p2p case that everybody is paying attention to. I like when cases reach the Supreme Court, because I think they are the only branch of the government that has behaved with integrity lately and they seem to be the only people left who have a sense of fairness, who make decisions based on the merits, and who have the courage to stand by what is right and to stand up to tyranny and corruption in other branches of the government.

If the Supreme Court rules against Grokster because of its p2p technology, it would cause a change in the way things have been done ever since their 1984 Betamax decision, in which VCR manufacturers were not held accountable for the potential copyright infringement of the VCR machines they were selling. I expect the Supreme Court to rule in favor of Grokster on the aspect of the p2p technology.

If Grokster loses it's not the end of filesharing, because there are still open source p2p programs which can't be shut down. MGM has undoubtably had more movies of theirs traded by way of BitTorrent than by way of Grokster, but it would be harder for them to build any case against BitTorrent developer Bram Cohen due to BitTorrent being open source and him making no money except donations off of it. So the very commercialism of these p2p companies has also increased their risk of lawsuits. Sharman Networks is currently being sued by ARIA in Australia.

BitTorrent also wouldn't work because it has a lot of non-infringing uses and is, in fact, used in a ton of ways that don't infringe copyright. Grokster and the others p2ps have always had a tougher arguement in terms of that. At the least, they are barely used for anything non-infringing, while you'll find legal uses of bittorrent all over the net since it's truly a great way to distribute popular, large, files - and not just ones where the users don't possess the copyright to distribute.

eclectica, either ban Tim or moderate enough to delete his posts that have nothing to do with the threads in question. I mean, I clean spam off b00mb0x all the time and I don't think I'm stifling freedom of speech. You can do the same.
